Terms of Service

1. Agreement to Terms

Welcome to Causative Coaching. By accessing or using our AI-powered life coaching platform (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you disagree with any part of these terms, you may not access the Service.

IMPORTANT: These Terms contain an arbitration agreement and class action waiver that affect your legal rights. Please read Section 14 carefully.

2. Description of Service

Causative Coaching provides:

• AI-powered life coaching and wellness guidance
• Goal tracking and progress monitoring
• Mood and habit tracking
• Journaling and reflection tools
• Evidence-based therapy techniques (CBT, ACT, SFBT)
• SMS and voice coaching features
• Third-party integrations (calendar)

Not a Substitute for Professional Care: Causative Coaching is a wellness and personal development tool. It is NOT a replacement for professional mental health treatment, medical advice, or therapy. If you are experiencing a mental health crisis, please contact emergency services or a licensed professional immediately.

3. Eligibility

To use Causative Coaching, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding contract
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Not be located in a country subject to U.S. government embargo

4. Account Registration

When you create an account, you agree to:

• Provide true, accurate, and complete information
• Maintain and update your information to keep it accurate
• Keep your password confidential and secure
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or illegal activity.

5. Subscription and Payment

5.1 Subscription Plans

Causative Coaching offers tiered subscription plans:

• Free Plan: Limited features and usage
• Starter Plan: Basic coaching features ($19/month)
• Pro Plan: Advanced features and integrations ($49/month)
• Executive Plan: Premium features and priority support ($99/month)

*Pricing subject to change with 30 days notice to existing subscribers

5.2 Billing

• Subscriptions are billed monthly or annually in advance
• Charges are processed through Stripe payment processing
• You authorize us to charge your payment method for renewal
• All fees are non-refundable except as required by law
• Failed payments may result in service suspension

5.3 Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until the period ends. No refunds for partial periods.

5.4 Free Trial

We may offer free trials for new subscribers. If you do not cancel before the trial ends, you will be automatically charged for a subscription. Trial eligibility is limited to one per user.

6. User Content and Data

6.1 Your Content

You retain ownership of all content you create (goals, journal entries, conversations, etc.). By using the Service, you grant us a limited license to use, store, and process your content solely to provide the Service.

6.2 Content Guidelines

You agree NOT to use the Service to:

• Post illegal, harmful, or offensive content
• Harass, threaten, or abuse others
• Impersonate others or misrepresent your identity
• Violate intellectual property rights
• Attempt to manipulate or deceive the AI system
• Share private information of others

6.3 Data Backup

While we maintain regular backups, you are responsible for maintaining your own backup copies of important content. We are not liable for data loss.

7. Acceptable Use

You agree NOT to:

• Use the Service for any illegal purpose
• Attempt to bypass security measures or rate limits
• Reverse engineer or decompile the Service
• Scrape or crawl content using automated means
• Overload or interfere with Service infrastructure
• Create multiple accounts to evade restrictions
• Resell or redistribute access to the Service
• Use the Service to compete with us

Violation of these terms may result in immediate account termination without refund.

8. AI Coaching Limitations

8.1 Not Medical Advice

The AI coach provides general wellness guidance and is NOT a licensed therapist, counselor, or medical professional. The Service does not provide medical diagnosis, treatment, or professional mental health care.

8.2 Crisis Situations

If you are in crisis or considering self-harm:

• Call emergency services (911 in the US)
• Contact the National Suicide Prevention Lifeline: 988
• Go to your nearest emergency room
• Contact a licensed mental health professional

Do NOT rely on Causative Coaching for crisis intervention or emergency situations.

8.3 AI Accuracy

While we strive for accuracy, AI-generated content may contain errors, biases, or inappropriate suggestions. You should exercise judgment and critical thinking. We are not liable for decisions made based on AI recommendations.

9. Intellectual Property

9.1 Our Property

Causative Coaching, including all software, designs, text, graphics, logos, and trademarks, is our property or that of our licensors. You may not copy, modify, or create derivative works without permission.

9.2 Your License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes.

9.3 Feedback

If you provide feedback or suggestions about the Service, you grant us the right to use such feedback without compensation or attribution.

10. Third-Party Services

Causative Coaching integrates with third-party services (Stripe, Twilio, Google Calendar). Your use of these services is subject to their respective terms of service. We are not responsible for third-party services or any changes they make.

11. Disclaimers and Limitations

11.1 Service “As Is”

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11.2 No Guaranteed Results

We do not guarantee specific outcomes, improvements, or results from using the Service. Personal development results vary by individual.

11.3 Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted access. We may suspend the Service for maintenance, updates, or technical issues.

11.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COACH AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Causative Coaching, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of third-party rights
• Your content or conduct

13. Termination

13.1 By You

You may terminate your account at any time by deleting your account in settings or contacting support.

13.2 By Us

We may suspend or terminate your access immediately, without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Abusive behavior toward our team or other users
• Non-payment of fees
• Long-term account inactivity (12+ months)

13.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy. Provisions that should survive termination (payment obligations, indemnification, limitations of liability) will continue to apply.

14. Dispute Resolution

14.1 Informal Resolution

Before filing a claim, you agree to contact us at legal@causativecoaching.com to attempt to resolve the dispute informally. We will work in good faith to resolve issues within 60 days.

14.2 Binding Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. Arbitration will be conducted in Minneapolis, Minnesota, or remotely by agreement of the parties.

14.3 Class Action Waiver

YOU AGREE TO RESOLVE DISPUTES ON AN INDIVIDUAL BASIS ONLY. You waive the right to participate in class actions, class arbitrations, or representative actions. This waiver is material to this agreement.

14.4 Exceptions

You may bring claims in small claims court if they qualify. We may seek injunctive relief in court to protect our intellectual property.

15. General Provisions

15.1 Governing Law

These Terms are governed by the laws of the State of Minnesota, United States, without regard to conflict of law principles.

15.2 Changes to Terms

We may modify these Terms at any time. Material changes will be notified via email or in-app notification at least 30 days before taking effect. Continued use after changes constitutes acceptance.

15.3 Severability

If any provision is found unenforceable, the remaining provisions will continue in full force and effect.

15.4 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Causative Coaching regarding the Service.

15.5 Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations to any successor or affiliate.

15.6 No Waiver

Our failure to enforce any provision does not waive our right to enforce it later.
